Giovannelli e Associati wins a court trial on negative goodwill and registration tax

Two Italian subsidiaries respectively belonging to the multinationals Benvic Group and Inovyn Group obtained a positive ruling from the Upper Tax Court of Milan in a case dealing with the registration tax in a sale of business concern against a symbolic price justified by the presence of a material negative goodwill. The second-tier judgement turned around the first-tier judgement which ruled against the taxpayers. Our firm defended the taxpayers with partner Eugenio Romita and associate Lorenzo Mazzocconi.
