HOT LABOUR TOPICS – Project-work is comparable to fixed-term employment

With ruling n. 24100, 26^th September 2019 (see here the full text in Italian) the Supreme Court highlighted the fixed-term nature of project-working (“contratto di collaborazione a progetto”), thus applying – in case of conversion – the same indemnity applicable to a fixed-term employment.

The Supreme Court stated a project-work agreement is comparable to fixed-term employment on the ground of it necessarily ending when its agreed goals are reached: for this reason, in case of conversion the indemnity between 2.5 and 12 monthly salary (pursuant to the former version of Art. 32, clause 5, Law 183/2010) shall apply.
