With ruling n. 13420, 17th May 2019 (see here the full text in Italian), the Supreme Court confirmed the dismissal for cause of a station manager that allowed a foreign homeless to stay two nights in abandoned spaces of the station.
In addition to the unlawful use of corporate assets (especially considering the employee’s managing role), the dismissal was grounded on the employee’s silence during the disciplinary procedure as well as his decision to leave his place of work on two times for 10/15 minutes; conversely, no relevance had the merciful and humanitarian intent of the employee.
